The website www.we-buy-any-bike.com is operated by WIR BUY YOUR MOTORCYCLE LTD located at Agia Eirini Beach Villas 61, 8504 Paphos. With our platform, we (providers) want to inform consumers and other visitors (hereinafter “user”, “seller” or “buyer”) about the conditions of use. In particular, the General Terms and Conditions regulate the relationship between the provider (Tobias Peuckert) and “buyers” who use the we-buy-any-bike.com platform commercially to buy motorcycles.
Our terms and conditions for the services of the we-buy-any-bike.com platform serve as the basis for regulating the rights and obligations of users (sellers) and dealers (buyers) who use the platform and agree to our terms and conditions by using it.
Our website allows a motorcycle seller to enter data into an input interface in order to receive an evaluation of the vehicle by email. The evaluation and the transmission of further data as well as the request for an assessment of a vehicle are free of charge. If you sell your vehicle, a separate sales contract must be concluded for this purpose. With the sale, the seller does not incur any further costs to the provider.
1. Subject of the contract
1.1 Rights and obligations of the seller
The seller is provided with an advertising platform by the provider. The seller receives up to three offers, after which both parties are able to conclude a purchase contract. For sellers, the posting of ads is always free of charge. The submission of an offer by a buyer in no way creates a binding agreement for the seller. An obligation to sell only arises from the acceptance of a purchase offer by the seller to the buyer according to the conditions agreed between the two parties.
The seller must already inform the potential buyer about any debt of the motorcycle and its conditions when placing an advertisement. Information on the responsible financial institution must be provided with the acceptance of an offer in order to arrange the processing of a refund. In addition, the buyer must be given the opportunity to make a refund. The terms of the refund are settled between the buyer and the seller.
By accepting an offer, the seller is no longer obliged to offer or sell the motorcycle to third parties (other than the buyer).
Furthermore, the seller is obliged to have the motorcycle and the associated documents and documents ready for the buyer on the day of collection. Damage caused by resale (e.g. a failed attempt to collect) must be reimbursed by the seller.
1.2 Rights and obligations of the buyer
Buyers can submit purchase offers. A submitted offer obliges the buyer to accept the conditions stated in the offer, which the buyer determines himself. In principle, the buyer may make ancillary agreements with the seller that are not explicitly regulated here. In any case, possible corrections and price changes to the contract between the buyer and seller must be settled when an offer is submitted, since the seller assumes a fixed price. Unless otherwise agreed, the offered price is a fixed price. If the buyer does not have data for submitting a binding offer, these must be collected before submission. Buyers can only be commercially active companies.
1.3 Rights and obligations of the provider
The provider is initially not a contractual partner in the sense of the sales process – seller and buyer conclude contracts without the provider.
The provider may remove ads – especially if you violate the terms of use mentioned.
The Provider is not responsible for the actions of the Sellers and Buyers and cannot, among other things, be held responsible for discrepancies in the area of:

2. Conditions for creating an advertisement by the seller
2.1 Conditions for sellers
The seller places an advertisement on the provider’s platform with the aim of selling his motorcycle. He affirms that he is the owner of the vehicle or is authorized to sell it. Sellers must be of legal age and resident in Germany.
2.2 Haftung bzgl. Urheberrecht, Rechteabtritt & Nutzung der erhobenen Daten
2.2.1 Urheberrecht & Persönlichkeitsrecht
Mit dem Schalten einer Anzeige garantiert der Verkäufer, dass er sämtliche Rechte – insbesondere die Rechte an Bildern und Texten, die für die Anzeige genutzt werden, also Urheberrecht, Persönlichkeitsrecht und Hausrecht (Ort der Aufnahme) – besitzt, und dass Bilder und Texte keine Rechte Dritter verletzten. Der Verkäufer darf keine Bilder nutzen, auf denen sich Personen befinden.
2.2.2 Liability in the event of copyright infringement

3. Processing

The purchase contract between seller and buyer regulates the further procedure, whereby the following framework conditions apply unless otherwise agreed:
3.1 In any case, the buyer guarantees that the seller will receive an appointment for collection and payment within three working days.
3.2 The handover generally takes place at the seller’s location, unless another location has been agreed.
3.3 The buyer undertakes to collect the motorcycle within two weeks of completion, unless another date has been agreed.
3.4 The motorcycle is to be paid for in cash if no other means of payment has been agreed.
3.5 Before making a payment, the buyer has the right to inspect the motorcycle with appropriate measures.
Ausschließlich Käufer und Verkäufer sind dafür verantwortlich, dass der Abschluss des Vertrags mit deutschem Recht und dem Recht der jeweiligen Nutzer in Einklang stehen. Der Käufer hat dabei insbesondere etwaige erforderliche Belehrungen gegenüber dem Käufer ordnungsgemäß zu erbringen. Käufer und Verkäufer handeln ihre Konditionen eigenständig untereinander aus. Der Anbieter stellt hierfür lediglich die erforderliche Infrastruktur zur Verfügung, handelt jedoch nicht als Stellvertreter bzw. Erfüllungsgehilfe und wird auch nicht Vertragspartei eines zwischen dem Verkäufer und Käufer abgeschlossenen Kauf-Vertrags.
4. Zahlungen
4.1 Als Händler (Käufer) erhalten Sie die Möglichkeit Inserate einzusehen, die Verkäufer erstellt haben. Im Vorgang der Angebotsabgabe zu einem Inserat erhält der Händler Zugriff auf die Kontaktdaten eines Verkäufers. Neu registrierte Händler können insgesamt 10 Angebote kostenfrei an Verkäufer versenden und zu diesen uneingeschränkt Kontakt aufnehmen. Die Kontaktdaten zu weiteren Inseraten können Händler (Käufer) einsehen, indem Sie zusätzliche “Anfragen” erwerben. Die jeweils geltenden Preise und den jeweiligen Leistungsumfang können Sie einsehen unter
4.2 Außer wenn dies gesetzlich vorgeschrieben ist, ist der Anbieter nicht verpflichtet, Rückerstattungen an den Käufer zu leisten. Wenn der Anbieter entscheidet, dem Käufer gezahlte Gebühren vollständig oder teilweise zurückzuerstatten, kann die Rückzahlung nur über das Zahlungsmittel erfolgen, das ursprünglich für den Kauf verwendet wurde.
4.3 Mit der Nutzung des Startguthabens können dem Käufer keinesfalls Kosten gegenüber dem Anbieter entstehen. Kosten entstehen lediglich beim separaten Erwerb von neuen Anfragen.
5. Kündigung, Mängel & Widerrufsrecht
Verkäufer und Käufer können das durch diese AGB geregelte Vertragsverhältnis jederzeit schriftlich via Mail an info@we-buy-any-bike.com oder auf dem Postweg kündigen an Tobias Peuckert, Lütticher Str. 222, 52064 Aachen. Mit der Kündigung werden sämtliche Daten, die zur Erfüllung der rechtlichen Pflichten der Käufer, Verkäufer und des Anbieters nicht nötig sind, umgehend vernichtet.
Ein bestätigtes Angebot / Kaufvertrag ist von dieser Kündigung nicht betroffen und unterliegt der Regelung im Kaufvertrag.
Mängel sind schriftlich zu entrichten an info@we-buy-any-bike.com und werden schnellstmöglich bearbeitet.
Anpassungen der AGB behalten wir uns im Rahmen der gesetzlichen Möglichkeiten vor. Käufer und Verkäufer werden über Anpassungen im Vorfeld rechtzeitig informiert.
5.1 Kündigung einer Mitgliedschaft
Die Vertragslaufzeit des Nutzungsvertrags richtet sich nach der jeweiligen Mitgliedschaft, die der Käufer (Händler) wählt. Diese sind einsehbar unter. Der Nutzungsvertrag verlängert sich jeweils automatisch um die jeweilige Laufzeit der Mitgliedschaft, wenn er nicht unter Einhaltung einer für die jeweilige Mitgliedschaft vereinbarten Kündigungsfrist zum jeweiligen Ende der Vertragslaufzeit formgerecht gekündigt wird. Die jeweils vereinbarte Kündigungsfrist bzw. das Ablaufdatum einer monatlichen Mitgliedschaft ist im Nutzerkonto unter dem Menüpunkt „Mein Profil“ > “Mitgliedschaft ändern” oder “Meine Rechnungen” ersichtlich.
5.2 Änderung der Mitgliedschaft
Käufer können die Art der Mitgliedschaft ändern. Ein Upgrade in eine Mitgliedschaft mit größerem Funktionsumfang ist jederzeit möglich.
5.3 Widerrufsrecht, Widerrufsbelehrung
Käufer und Verkäufer haben das Recht, binnen vierzehn Tagen ohne Angabe von Gründen diesen Vertrag zu widerrufen. Die Frist beginnt nach Erhalt dieser Belehrung in Textform, jedoch nicht vor Vertragsschluss und auch nicht vor Erfüllung unserer Informationspflichten gemäß Artikel 246 § 2 EGBGB. Um Ihr Widerrufsrecht auszuüben, müssen Sie unter Tobias Peuckert, Lütticher Str. 222, 52064 Aachen, info@we-buy-any-bike.com schriftlich über Ihren Entschluss, diesen Vertrag zu widerrufen, informieren. Sie können dafür das beigefügte use, but is not mandatory. 6. Final Provisions
For matters that are not regulated in our General Terms and Conditions, the relevant legislation in the respective country applies. Should individual provisions of these General Terms and Conditions not be legally effective, the validity of the General Terms and Conditions will otherwise not be affected. The invalid provisions are replaced by statutory provisions. The terms and conditions are valid from 02.07.2018.
